01 Agreement to terms
By accessing or using Whitewater OS (the “Service”), operated by Whitewater Intelligence LLC (“Whitewater,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.
02 Eligibility
You must be at least 18 years old and able to form a binding contract to use the Service. By using Whitewater OS, you represent that you meet these requirements.
03 Your account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly at hello@whitewaterintelligence.com if you suspect any unauthorized use.
04 Acceptable use
You agree not to: use the Service in violation of any law; attempt to gain unauthorized access to other organizations’ data; reverse engineer, scrape, or interfere with the Service; upload malicious code; or use the Service to harass, abuse, or harm others.
05 Your content
You retain ownership of the content you submit to the Service. You grant Whitewater a limited license to host, store, process, and display your content solely for the purpose of providing the Service to you and your organization.
06 Organization administrators
If you use Whitewater OS as part of an organization, an administrator of that organization may control your account, including access permissions and data retention. You should review your organization’s internal policies.
07 Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
08 Intellectual property
The Service — including all software, designs, text, graphics, and trademarks — is owned by Whitewater Intelligence LLC and is protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.
09 Pricing & payment
During early access, pricing terms are communicated separately. When paid plans are introduced: fees are charged in advance on a monthly or annual basis; all fees are non-refundable except as required by law or as explicitly stated; and we will provide reasonable notice before changing pricing for existing customers.
10 Termination
You may cancel your account at any time by contacting hello@whitewaterintelligence.com. We may suspend or terminate your access to the Service if you violate these Terms, with or without notice depending on the severity of the violation. Upon termination, your right to use the Service ends. We will retain and delete your data in accordance with our Privacy Policy.
11 Disclaimers
THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WHITEWATER INTELLIGENCE LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.
12 Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WHITEWATER INTELLIGENCE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
13 Governing law
These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict-of-law provisions. Any disputes shall be resolved in the state or federal courts located in Georgia.
14 Changes to these terms
We may update these Terms from time to time. We will notify you of material changes via email or a notice within the platform. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
